Filing for a green card for a spouse or relative is exciting, but the Affidavit of Support (Form I-864) is where most dreams hit a wall.
As a tax preparer in Yonkers helping immigrant families since 1985, I have seen more applications delayed by this single form than anything else.
The USCIS (immigration) doesn't care if you are a "good person." They care about math. They want to prove your relative won't become a "Public Charge." If your tax returns don't match the story you are telling immigration, your application will be rejected.
Here is why you should never let a "notario" or a generic tax filer handle your Affidavit of Support.
1. Adjusted Gross Income vs. Total Income
The most common mistake I see on South Broadway: People look at their paystub (Gross Income) and write that number on the I-864. Wrong. Immigration looks at line 11 of your Form 1040 (Adjusted Gross Income). If you loaded your tax return with too many deductions to "save money" on taxes, you might have accidentally disqualified yourself from sponsoring your wife or mother.
- The Pupilo Strategy: We analyze your last 3 tax returns before we fill out the immigration forms. If your income is too low, we fix it or find a joint sponsor.
2. The Joint Sponsor Trap
If you don't make enough money, you need a Joint Sponsor.
- The Mistake: Asking a friend who hasn't filed their own taxes correctly.
- The Reality: The Joint Sponsor is legally on the hook for 10 years. We explain this responsibility clearly so your sponsor doesn't back out at the last minute.
3. Self-Employment Evidence
Are you self-employed (Uber, Construction, Cleaning)? USCIS is suspicious of self-employment income. A simple tax return isn't enough. We prepare a "Sponsor Packet" that includes your Schedule C, bank statements, and business license to prove your income is real and stable.
Don't Gamble with Your Family's Future
A rejected I-864 means months of delays and potentially re-paying government filing fees.
I am not just a tax preparer; I am a Certifying Acceptance Agent and an expert in immigration tax compliance. I speak the language of the IRS and the USCIS.
